Authorized Use Policy ("AUP")

1 Purpose & Scope

This AUP establishes rules for using FuturaCMS in conjunction with any payment functionality. It incorporates and requires compliance with:

  • PayPal Acceptable Use Policy ("PayPal AUP") — latest version available at https://www.paypal.com/legalhub/paypal/acceptableuse-full.

  • Stripe Restricted Businesses & Services Agreement (collectively, "Stripe AUP") — see https://stripe.com/restricted-businesses and https://stripe.com/legal/ssa.

References herein to "Payment Processor AUPs" mean both PayPal AUP and Stripe AUP. Where these policies differ, you must comply with the most restrictive requirement.

2 Prohibited Activities

You may NOT use FuturaCMS to facilitate, promote, or process transactions involving:

  1. Illegal or harmful activities — any activity that is unlawful, exploits minors, encourages violence or self‑harm, or violates consumer‑protection, privacy, or export‑control laws.

  2. Infringing or counterfeit items — products or content that infringe trademarks, copyrights, trade secrets, or other intellectual‑property rights.

  3. Regulated goods & services — including but not limited to:

    • Controlled substances, narcotics, or drug paraphernalia;

    • Tobacco, e‑cigarettes, or vaping products;

    • Firearms, ammunition, weapons, or weapon accessories;

    • Adult content or sexually explicit material where prohibited by the Payment Processor AUPs or local law;

    • Live animals or endangered species products.

  4. High‑risk financial practices — get‑rich‑quick, pyramid or Ponzi schemes, counterfeit currency, unlicensed money services, investment or credit‑repair services without proper authorization.

  5. Gambling & games of chance — lotteries, sweepstakes, online casinos, fantasy sports, or skill‑based wagering unless you have obtained written pre‑approval from both PayPal and Stripe where required.

  6. Certain travel & ticketing services — airlines, charter flights, cruises, timeshares, or event tickets scheduled for future dates, unless pre‑approved under Payment Processor AUPs.

  7. Cryptocurrency & virtual assets — exchange or sale of cryptocurrency, NFTs, or virtual goods unless explicitly permitted by both PayPal and Stripe and you have secured all required licences and approvals.

  8. Products or services Stripe specifically restricts — e.g., psychic services, debt collection, bail bonds, high‑interest lending, or any category listed on Stripe’s Restricted Businesses page.

3 Activities Requiring Prior Approval

Some categories are conditionally permitted only after you obtain prior written approval from the relevant Payment Processor(s) and provide us with evidence of such approval. These include, without limitation:

  • Charities & nonprofit fundraising;

  • Telemedicine or prescription drugs;

  • Subscription boxes with negative‑option billing models;

  • Marketplace or platform models where you accept payments on behalf of third parties.

4 User Responsibilities

  • Due Diligence & Compliance. Ensure your offerings comply with all applicable laws, this AUP, and each Payment Processor AUP. Review the processors’ policy updates regularly.

  • Approvals. Obtain and maintain any required pre‑approval from PayPal and/or Stripe before launching a restricted activity. Keep documentation available for audit.

  • Co‑operation. Respond promptly to our or a processor’s compliance enquiries. We may share relevant account and transaction data with processors to facilitate their review.

5 Monitoring & Enforcement

We, PayPal, and Stripe each reserve the right to monitor transactions and investigate any activity believed to violate this AUP. We may, without notice:

  • Suspend or terminate access to payment features or the entire Service;

  • Cancel or reverse transactions;

  • Remove or disable access to offending content or listings;

  • Report suspected illegal activity to law‑enforcement or regulatory authorities.

Repeated or egregious violations may result in permanent platform bans and legal action.

6 Reporting Violations

To report suspected AUP violations:

  • Email [email protected] with details.

  • Report directly to PayPal at https://www.paypal.com/us/smarthelp/contact‑us or Stripe at https://support.stripe.com/contact.

7 Amendments

This AUP may be updated at any time. We will post the revised version with a new "Last updated" date. Continued use after changes constitutes acceptance.
